Descendants of Michael Ailstock
On January 5, 1860, my third great-grandparents, Annie Elizabeth Ailstock and Charles Edward Grigsby were married in Rockbridge County, Virginia. Charles was born in Wayne County, New York, the son of Samuel and Mary (Evenden) Grigsby - immigrants from Kent County, England. Charles and Annie remained in Rockbridge County for a while, and then later lived in Millboro, Bath County, Virginia. Some time after the 1880 census, Charles and Annie Grigsby moved to Bingham County, Idaho. Annie and Charles Grigsby’s son, Sanford Samuel Grigsby, ended up living in Fayette County, West Virginia where he married Susan Mary Ennis, in 1897. Susan Ennis was the daughter of James W. and Hulda Jane Kincaid Ennis of Fayette County. Sanford and Susan were the parents of my great-grandfather, Forrest Leonard Grigsby.
Annie Elizabeth Ailstock Grigsby died in Bingham County, Idaho on March 13, 1913. According to Charles Grigsby, the informant on Annie’s death certificate, Annie’s parents were Andrew Ailstock and Phoebe Vess. I am still trying to verify the parentage of Annie Elizabeth Ailstock.
One lead in determining Annie’s parents comes from the will of Andrew Ailstock – written August 1862 and produced in court in November 1862 a short time after his death. In his will, Andrew states that he was never married to Phoebe Ann Morris in the 8 years they had been together, and as his common-law wife, Phoebe had 3 children by him (Alice, Sarah, and Julia). This leads to my own theory on Annie’s real parents.
Of all the assertions made on the parents of Annie Elizabeth Ailstock I have not seen any that address the issue that Phoebe “Vess” is the mother of Annie. This has been reported in Annie’s death certificate and through family lore (shared by my grandmother, Alma Grigsby Mitchell)—two separate sources. Somewhere the Vess family ties come into the picture but I have been unable to make a connection. I have entertained the idea that Andrew’s first wife as remote as it may sound, might also have been Phoebe/Mary (Mary is an interchangeable name). Discounting this theory, the closest I can come to a plausible solution concerns the coincidental August 6, 1832 marriage of William Vess and Phoebe Morris in Rockbridge County, Virginia. It is possible that there could be an illegitimate Phoebe/Mary Morris daughter[1] or a Phoebe Vess daughter in this marriage that would provide some answers. There is some information on-line about this family but I have yet to locate any other documentation on William and Phoebe Morris Vess. Nevertheless, this is an avenue of research I continue to look into as well as several others.
It is reported to me from Ailstock cousin, Kitty Sachs, that Andrew Ailstock and Phoebe Ricket Morris, one time wife of Elihu B. Morris, were married by common law—and that Andrew adopted Phoebe’s children from her previous marriage (this would have to be Preston and Annie Elizabeth). I have done considerable research on Elihu and his wife Phoebe. The main problems I note here concern the fact that Elihu and Phoebe continue to live together as husband and wife well after Andrew Ailstock has died. Also, Elihu’s Phoebe is consistently ten years older than Andrew’s common-law wife. If Andrew’s Phoebe was married prior to them living together I have been unable to locate her, her first family or the son she had prior to 1850 (Preston). Somewhere there has to be a record of Phoebe Morris, as a wife or as a child that will help solve this mystery. A totally different name is introduced in another ancestral account.
Noted Ailstock researcher, Odell McGuire, relays that: John Ricketts, a free Negro, made and laid bricks at Rockbridge Alum Springs where the Sally Ailstock family lived—Sally was Andrew Ailstock’s mother. John Ricketts daughter, Phoebe Ricketts, became Andy Ailstock's common law wife. She brought older children to the marriage and had Children by Andrew, as well. Andrew did not acknowledge the older children in his will, but they went by the Ailstock name.
One crucial fact is apparent with all the theories I have run across trying to determine the parents of Annie Elizabeth Ailstock, it is the likelihood that one of her reported parents, Andrew Ailstock or Phoebe Morris, is not her natural parent. Either, both Preston and Annie Elizabeth were from a previous wife of Andrew Ailstock’s or they were in fact brought into the family from the union of Phoebe Morris, and, as of yet, their unknown father.
One point of debate that continues to arise among Ailstock researchers concerns the racial background of the Ailstock line. Michael Ailstock is the most commonly agreed upon progenitor of the Rockbridge County, Virginia Ailstock families—in a number of documented records, he and his descendants are identified as “mulatto” and described as “free negro”. Many believe that the descendants of Michael Ailstock are mistakenly identified and are actually Indian in heritage. Ilene Andrus, descendant of Bertha Grigsby Founds, daughter of Charles and Annie Ailstock Grigsby, shares that Annie herself claimed to be related to Chief Cornstalk, noted Shawnee Indian chief of the 1700’s. Ailstock cousin, Diana Havens, expands on the Indian heritage view in an article within this text. In the event that it is determined that Andrew Ailstock is indeed the biological father of Annie Elizabeth Ailstock I have recorded lots of information on Andrew’s great-grandfather, Michael Ailstock and his descendants—if proven, he would be my 7th great-grandfather.
Michael Ailstock was born in the early 1700's and died in Louisa County, Virginia, in 1795. All of the early Ailstock information I have comes from cousins on the internet—one major contributor, Ralph Aylstock. Another piece of crucial documentation is the Will of Michael Ailstock—it lists all his living children at the time (1791) and is a good jumping off point for further research. The son of interest in this research is Absalom.
The first census record I have is in 1810 - Aylstock, Absolem pg.604 Botetourt Co, VAA free black head of household (not sure this one is Michael's son). I also show an 1810 Tax List record in Louisa County for Absalom Ailstock - 1 white tithable. Thanks to Fred Aylstock, another cousin, I have a record of the pension request Absalom made for his service during the Revolutionary War. According to "Virginia Soldiers of 1776", by Burgess (1973, pg. 1246/7), Absolem Ailstock enlisted as a Private in the Albemarle Company of Captain Harris (joined at Williamsburg, 19 Sept., 1781 and was discharged 6 Nov. after 48 days). Also, Fred provided me with a deed record for the land in Rockbridge County, VA, that Absalom received for his war service. The last census record I have on Absalom is in 1850 Rockbridge County, VA – he is reported to be a “malato” and aged 94. From internet cousins I learned that the father of Andrew Ailstock was Absalom’s son, Thomas.
The first census record I find Thomas Ailstock is in 1830 Alleghany County, Virginia. Unfortunately, because of his “free negro” status only his name is recorded and no specifics on his family members are given, except that there is a female 40-49 years of age in the household. By 1840 Thomas had died and his wife, Sally, is widowed and living in Augusta County – the exact location, date, and circumstances of Thomas’s death are unknown. By 1842, Sally Ailstock and her family are located in Rockbridge County, Virginia.
Andrew Ailstock, son of Thomas and Sallie, is found living with his mother in the 1850 Rockbridge County, VA census. In 1860, he is with his common-law wife, Phoebe Morris, and 5 children (including Annie Elizabeth Ailstock). The last record I have of Phoebe Morris is in the 1870 Rockbridge County, Virginia census. I found one source on the internet that reports her death date as 1893, but I still need to confirm this as fact.
I have included within this text information pertaining to the Vess/Vest, Rickett(s), and Morris families for future reference in solving the mystery of Annie Elizabeth Ailstock’s parents.

Know all men by these presents; thae we Michael Ailstock and John Churchman are held and firmly bound undo James P. Preston Governor of Virginia and his successors, for the use of the Commonwealth, in the sum of one hundred and fifty dollars, to which payment well and truly to be made, we bind ourselves, our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals and dated this 30th day of July A.D. 1818.
The condition of the above obligation is such, that whereas a marriage is shortly intended to be solemnized between the above bound Michael Ailstock ??? bachelor and Margaret Cosward widow, both free persons of colour of Augusta county, if therefore, there shall be no lawful cause otherwise to remain in full force and virtue.

State of Virginia
Rockbridge County; October 1, 1832
On this day personally appeared in open Court, before the justices of said Court, said Court being a Court of record, and now sitting. Absalom Ailstock a resident in said County and State, aged 70 years, who being first duly sworn according to Law, doth on his Oath, make the following declaration, in order to obtain the benefit of the Act of Congress, passed June 7th 1832.
That he entered the service of the United States, under the following named officers, and served as herein stated. This applicant is a free born Mulatto, and not being able to read, or write, is too unacquainted with dates, to be particular, as to the exact periods when he went into the service.
This applicant states, that he was born in Louisa County, State of Virginia, (the year he does not know having no record of his age, where he lived until 17 or 18 years after the Revolution, when he moved to this County, where he has since lived. He states that his first service in the Revolution, was from the County of Louisa, in this State, the Militia having been called out by divisions under Col. Nelson & Captain John Saunders, both of Louisa County, it being rumored that the British were about to land upon the Virginia Coast, he cannot state in what year this happened, but believes it was in the year preceding Cornwallis' defeat, and thinks he was about 17 years old from the circumstance, that a short time previous to this, he was not capable of standing a draught for 18 months, not being 18 years of age, the age required by Law, and that in the summer following his first tour, he did stand a draught for a term of 18 months, but drew clear. He states that he moved from Louisa County in the beginning of the winter, to Hanover Courthouse, in this state, where he went under the command of Col. Fountaine (sp) and Major Winston, Adjutant officers, and Col. Nelson returned home, thence proceeded to New Kent Courthouse, received orders (as the applicant thinks from the Governor, after remaining one week at New Kent Courthouse, and returned to Hanover Courthouse, there remained two or three weeks, when Adjutant Mayers (if the applicant recollects right, he being called by the soldiers Sandy Mayers), was sent to the Governor for further orders, who returned with directions to dismiss the men. And this applicant returned, after a service of 4 weeks he received no discharge, the orders from the Governor being a general discharge to the Louisa Militia, as he understood from it being read aloud by Adjutant Mayers.
This applicant further states, in the same summer as he was in his first tour, in the spring following, about the 1st of April, in the year of Cornwallis' Defeat, and marched from said County under Capt. William Harris of Louisa County, directly to Richmond, where he joined the 2nd Regiment, under Col. Richardson and Major Armistead. The British he states had been at Manchester on the opposite side of the river, and burned the Tabacco ware houses (sic), the ruins of which this applicant distinctly saw from the Richmond side. Thence marched down the River in Nelson's Brigade, how far he cannot say, to a place called as he believes "Marben Hills" upon the river, where the Brigade was stationed, for the reason as this applicant believes, that the British were in the habit of coming up the River as high as this place in two gun boats (little boats with a gun on each end) for the purpose of Plunder, whilst here Col. Richardson had a skirmish with the gun boats, two of which he took, and 17 men Prisoners, thence marched down the River, about a day's journey, thence across to Spotsylvania, where this applicant's term of service expired, and he was discharged. This applicant gave his discharge to one of his fellow soldiers, not having a safe place to keep it, and has never seen it since. This tour was 3 months & 2 days.
This applicant states that he served another tour of 3 month's service, having been called out in the same manner as formerly, about the middle of July succeeding the last term, and marched to near old Williamsburg, under Capt. Benjamin Harris of Louisa County, where he joined Nelson's Brigade (afterwards at York called Lawson's Brigade). Col. Richardson was a field officer in this Brigade, and Major Martin had taken the place of Major Armistead, as the applicant believes, thence marched below Williamsburg a short distance where the Brigade encamped until Washington's troops came in from the north, in the rear of which, the Brigade fell and marched on to York. This applicant states that the Battle was commenced on Sunday morning, by the French at the Poplar Redoubt, and the next day, the regiment to which this applicant belonged, was transferred to the redoubt, for the purpose of changing it into a gun battery. This applicant that he was occupied during the siege in digging intrenchments, and making sand baskets and facines (sp) for the intrenchment Batteries. This applicant received his discharge by order of General Lawson, from aides by Sergeant Shelton, which discharge he delivered to one of his mess mates, for safe keeping, and has never seen it since. This applicant's service was in this tour was 3 months lacking 4 or 5 days.
This applicant can refer to the knowledge of no living witness in his behalf. But to Daniel Ruth of his neighborhood, James D. Davidson, Richard Harris and the Rev. Andrew B. Davidson all of said County, as evidence in his behalf.
This applicant hereby relinquishes every Claim to a Pension or Annuity, except the present, and declares that his name is not in the Pension Role of the Agency of any State.

I Daniel Ruth of the County aforesaid, and residing in the neighborhood of the applicant who has sworn to and subscribed the above declaration, do certify, that I am well acquainted with the said Absalom Ailstock. That I believe him to be 70 years of age, as he represents, that he is a free born Mulatto, and has always supported an unimpeached Character for honest and verocity. That is the general belief of his neighborhood that he served Revolution . . . to my knowledge have ever existed upon the subject, and that I concur in that opinion. TO ALL WHOM THESE PRESENTS SHALL COME, GREETING: KNOW YE, That in conformity with a survey, made on the ninth day of November 1826, by virtue of the said office Treasury Warrants, to wit: 49 acres and 150 square poles by Nº 5067 and 150 acres by Nº 5984 filed May 1st, 1813 there is granted by the said Commonwealth, unto Absalom Ailstock, A certain Tract or Parcel of Land containing One Hundred and Ninety nine acres and 150 square poles situated in Rockbridge on the Mill Mountain and on the waters of Bratton's Run a branch of the Big Calfpasture River and bounded as followeth, to wit Beginning at a Chesnut Oak near the foot of Mill Mountain, thence along the foot of said Mountain N 33ºE crossing the two spring branches (the first at 15 poles and the other at 72 poles) 228 ½ poles to three pines at the pint of a ridge thence N57W140 poles to the two Chesnut Oaks and a Black Oak on the top of said Mountain, near the top thereof S33ºW (crossing the road leading from Lexington to Millborough at 159 poles) 228 ½ poles to four pines, thence S57ºE crossing said road at 69 poles) 140 poles to the beginning.
TO HAVE AND TO HOLD the said Tract as Parcel of Land with its appurtenances, to the said Absalom Ailstock and his heirs forever.

James Going, [Moses6, Agnes5, Edward, Jr.4, Edward3, William2, Mihil1] regarded as a son of Moses Going and Agnes Going, was born about 1768 in Louisa County. He was married February 12, 1799 to Beckey Ailstock, according to "Albemarle County, Virginia Marriages, 1772-1850." The Ailstock family was a prominent mulatto family in Louisa County. Rebecca "Becky" Ailstock was a daughter of Absalom Ailstock, a mulatto who served in the Revolutionary War, according to an account of him in "Free African Americans of North Carolina and Virginia." Children born to James Going and Beckey Ailstock Going are unknown.
Jesse Going was married February 12, 1799 to Jenny Ailstock, according to "Albemarle County, Virginia Marriages, 1772-1850." Since they were married on the same date as James Going and Beckey Ailstock, they are believed to be brothers marrying sisters. It is believed that he accompanied his father in a move to Georgia about 1786. He was listed with him in the 1793 and 1794 tax lists of Warren County, Georgia. Children born to Jesse Going and Jenny Ailstock Going are unknown.
Elizabeth Going [Moses6, Agnes5, Edward, Jr.4, Edward3, William2, Mihil1], daughter of Moses Going and Agnes Going, was born about 1769 in Louisa County. "Aggy Gowin, parent" was a witness at the marriage of "Elizabeth Gowin" to John Douglas January 29, 1787, according to "Henrico County, Virginia Marriage Bonds, 1780-1851."
Mary Going, [Moses6, Agnes5, Edward, Jr.4, Edward3, William2, Mihil1] daughter of Moses Going and Agnes Going, was born about 1770. She "gave her own consent" to marriage with Meredith Childers December 23, 1791 in Henrico County. "John Goyne," brother of the bride, was security. "Aggy Goyne" and Richard Loving were witnesses.
Sherwood Going, [Moses6, Agnes5, Edward, Jr.4, Edward3, William2, Mihil1] regarded as a son of Moses Going and Agnes Going, was born about 1772. He was a namesake of his uncle, Sherwood Going. The orphans of Sherwood Going" [unnamed] were successful in the 1832 gold land lottery of Georgia. It was the final lottery of the state.
Moses Going, Jr, [Moses6, Agnes5, Edward, Jr.4, Edward3, William2, Mihil1] regarded as a son of Moses Going and Agnes Going, was born about 1774. Financial misfortune befell Moses Going, Jr. and in 1804 he was jailed for his debts, according to a legal notice published in a Lincoln County newspaper: "Matthew Raybon and Wm. Beggins, Executors of Benjamin Ship. vs. Moses Going.
Absolom & Nancy Jane m.9 July 1863, produced a child by the name of Agnes Catherine "Kate" Allstock b.1872. The following information was taken form a personal interview of William Harrison Riley the husband of Kate, that was done in 1940 by Charles Riley.
William stated in the interview that, Kate was full blood Indian, and that her parents (Absolom & Nancy Jane) were first cousins, and John & Margaret were first cousins, Andrew & Nancy were first cousins. Because his GrandFather was George Allstock b.1805 Alleghany Co., they were allowed to marry, and were given a large parcel of land in Millboro, by Absolom & Nancy Jane. He also went on to say, that a lot of Allstock's, were shamed by the government, but some themselves by declaring to be Mulattos, just to have the right to own land. He also stated that a few had married Blacks, as it was better to be Black than Indian. He also stated that the Allstock family were inhabitants of the Shanandoah Valley, from as far back as the early 1600's.
The aforementioned was from notes of Charles Riley, Charles grew up believing he was the son of William, it wasn't till a few years before his death, he found out, that he was his stepson, at that point he discontinued all research, Rick and family are researching his possible family line, and looking for Whitecotten, Moats and Simmons, in WV and VA, would love any information on these families, if anyone has a connection to them.
I have not seen the written statements, nor do I doubt Rick's memory of what she saw in her Father-in-laws papers. At present Rick just moved and all the paperwork, she has is in a moving van somewhere in PA, got a hold of her by accident, at her sons house.

My husband’s family has always said they were related to Chief Cornstalk. I am trying to find the connection. His grandmother was the daughter of Annie Elizabeth Ailstock, (husband was Charles Grigsby) I have traced this to Absalom Ailstock (wife Sally). Can you help me find any connection?
Cornstalk, born Wynepuechsika, circa 1720, in western Pennsylvania, moved with his family to Ohio in 1730. He fought with the French in The French and Indian War (1754-1763) against the British. He continued to battle settler encroachment into Ohio and at the Battle of Point Pleasant in 1774 both sides suffered heavy losses and the Indians retreated; signing the peace Treaty of Chillicothe in late 1774, promising not to attack settlers south of the Ohio River.
The confrontations continued, and in 1777, Cornstalk and a small group of Indians traveled to Point Pleasant to discuss stricter enforcement of the peace treaty. The whites, now in rebellion against the British, imprisoned the peace party. On November 10, a small group of militiamen stormed the jail, to avenge the killing of a white man by other Indians, and executed Cornstalk and his son.
According to local folklore, Point Pleasant has seen its share of devastating floods and fires, some attribute it to the dying curse of the great Shawnee chieftain, Cornstalk.[23]

The last page of a sad chapter of American history was written at this Ohio River community today.
Chief Cornstalk, the Shawnee Indian leader who was taken hostage and murdered by white men to whom he had come to talk peace, was given a final resting place in a small park near the field of his most famous battle.
His oft-moved grave now lies beside those of Colonial soldiers killed in that struggle—the battle of Pt. Pleasant, Oct. 10, 1774 and Frontier Heroine Ann Bailey.
In a lengthy ceremony at noon today, Cornstalk's last remains— three teeth and 15 bone fragments—were sealed in an aluminum box in the center of a four-ton stone monument bearing the simple inscription: "Cornstalk."
The monument and remains had been removed from the grounds of the old Mason County courthouse, which is being torn down to make way for a new court building.
It was at least the third time the chieftain's body had been interred.
After his death In 1777, he was buried near Fort Randolph the Colonial outpost at which he had been killed. Then in 1840, street- builders here unearthed his grave, and the remains were moved to the courthouse grounds,
This year, with the decision to raze Mason County's old courthouse and erect a new $700,000 structure in its place, it was decided to move the grave to historical Tu-Endie-Wei Park at the junction of Ohio and Kanawha Rivers.
Amateur archeologists began digging last Saturday morning, and after 10 hours of fruitless labor, it was feared that the chief's remains might not be found. But early Sunday, persistent diggers came upon rust stains from the metal box in which Cornstalk had been reburied. In loose earth, they found the teeth and bone fragments which were decided to be "undoubtedly those of Cornstalk."
The reburial today was directed by members of the Pt. Pleasant chapter of the Daughters of the American Revolution. The story of Cornstalk's seizure and murder is one of the dark spots in American history.
Born about 1735 in what is now Ohio, the future chieftain was named "Kei.gh-tugh-qua," meaning "maize plant"—hence the English name "Cornstalk."
Little is known of his early life, but by 1763 he had become a Shawnee tribal chieftain and led war parties against several white settlements.
In 1764, soldiers raided his tribal town and took him captive. He was carried to Fort Pitt as a hostage, but escaped the following year.
In the following years, he became Sachem of all Shawnee tribes and finally king of the northern confederacy of Indian tribes, composed of the Shawnees, Delawares, Mingoes, Wyandottes and Cayugas.
On Oct. 10, 1774, he led 1,100 of his braves against an equal number of Colonial troops at Pt. Pleasant and after a violent battle, was defeated.
Following his defeat, Cornstalk pursued a peace policy and forbade his braves to molest whites.
But in 1777, with the American Revolution at its height, he returned to Pt. Pleasant with two companions to warn settlers that the British were trying to incite his tribesmen to attack them.
Fearing an attack, Colonial soldiers seized Cornstalk and his companions and imprisoned them in Fort Randolph as hostages.
A month later, Cornstalk's son, Ellinipsico, came to the fort to see his father. During his visit, a soldier walking near the fort was killed by an Indian and other soldiers rushed to Cornstalk's quarters to kill him In revenge.
Cornstalk, who is described by historians as a handsome, intelligent, and highly honorable man, stood calmly in the doorway to his room and faced his slayers.
He was felled by nearly a dozen rifle shots. The soldiers then entered the room and killed Cornstalk's son and two companions.
The murder of their chieftain turned the Shawnees from a neutral people into the most implacable warriors, who raided Virginia settlements tor 20 years after the incident.
I have included this extensive research record by Dick Muterspaw within this text for a starting point to determine the mystery of Pheobe Vess – the reported mother of Annie Elizabeth Ailstock in her death certificate.

OF ROCKBRIDGE COUNTY, VIRGINIA

Introduction:
There are several publications which tell the history and lineage of the Rockbridge Co. Vess/Vest family but because there are so many inconsistencies and differences from my findings, I have decided to make an attempt to more accurately document the Vest story. If there are questions, disputes, or additions, please let me know. I am very confident that there is considerably more Vest data available that I haven’t uncovered at this time, however I feel compelled to write down my findings while they are fresh in my mind. When making an effort to insure total accuracy, it must be remembered that most records that we rely upon are usually copied manually and are subject to error. Even census records are copied from the original census takers manuscript to the final list and obviously this can be accidentally transcribed incorrectly. So with that in mind, we must make an assumption that what we think is definite, may be not be at all. My point is, if in my data there is an assumption, it is to assume that the records are accurate. And when I make other assumptions, it will be clearly spelled out.
My research on the family began some thirty five years ago but was dormant for several years until last year when I discovered that on the Internet there appeared to be several discrepancies on my direct line and then found that some of the written histories also contained data that differed from mine. This stirred my interest and I decided to do further research in an attempt to more accurately record the family history. I’m sure that my search is not over and that many questions may never be answered, however I’ve spent considerable time in an effort to unravel the many mysteries. In Rockbridge Co. alone there were at least 11 Vest households as early as 1840. Also, in the book, ‘Lexington and Rockbridge Co. in The Civil War’ by Robert Driver, there are 19 separate Vests that served. (Many served in more that one unit.) Making definite connections before 1850 is extremely difficult due to several reasons, such as; The U.S. census before 1850 lists only the head of the household (spouses and children are not named) , secondly the fact that the Vests did not make out ‘Wills’, and thirdly, that most of the Vest families used the same first names.
One of the unanswered questions is; ‘Where did the family come to Rockbridge Co. from?’ There were several Vest families that lived in Chesterfield Co., Va. in the early to mid 1700’s and there are several sons that could have fathered our line but at this time I haven’t found a definite connection. The only tiny clue that indicates there may have been a connection is through their vocation. The Vest family in Chesterfield Co. were and are still heavily into saw mills and lumber yards. While this may mean absolutely nothing, the Vest families in Rockbridge also ran various saw mills and were into carpentry. Another totally different possibility is that the 1880 census of Rockbridge Co. has Hiram Vest aged 71 (this was Hiram, son of Samuel,Sr.) listed that he and his parents both were born in Maryland. However, his siblings, that were still alive in 1880, were listed as being born in Va., as well as their parents which contradicts the Maryland possibility. So, that leads me to believe that Hiram’s listing was in error, although I’m still pursuing the possibility that this family migrated down the Shenandoah Valley via Maryland as our Muterspaw and several other families.
The earliest records that I’ve found that may apply to our Rockbridge Vest’s is possibly the Samuel and William Vess that lived in the southern part of Dunmore Co. (which now is called Shenandoah Co.) Note that this location is next to the northern part of Rockingham Co. In the 1775 Census of Dunmore Co. taken by Thomas Allen, both Samuel and William are listed with families. Since the record isn’t complete, it doesn’t give an accurate record of the number of children. Also listed under Dunmore Co. (lower district) is a William and a Samuel Vess that served in the Rev. War under Capt. Joseph Bowman. (See Exhibits A and B) My search in Shenandoah Co. court records did not reveal absolutely any deeds, wills, marriage, or court records of any Vess/Vest persons. Knowing that their location was the southern portion of the county, it is possible that the records found in the bordering county of Rockingham, could be the same families. Our problem is magnified due to the fact that the Rockingham Co.court records were burnt both during the Civil War and also many of their remaining records were destroyed in a later fire at the court house in Harrisonburg. Consequently, I haven’t found any deeds, or wills for our Vest family in Rockingham Co. Also, it should be noted that a William Vess and wife, both aged 26-45, along with a son, and 5 daugh. were in the 1820 census for Shenandoah Co. (They weren’t in the 1810 or 1830 census that I could find.) Who this William is I’m not sure.
It has been documented that a Samuel H. Vest I and Samuel H. Vest II both lived in Rockingham Co. in the early 1700’s and were the progenitors of our line, however, with several trips to the court house in Harrisonburg and to the local history library for Rockingham Co., I’ve been unable to find one single record to substantiate this fact. I would greatly appreciate anyone that can show me data to support this. Therefore, based upon the following census, marriage, deeds, and tax records from both counties of Rockingham and Rockbridge, it is my theory that 3 brothers by the name of John, Samuel, and Hiram moved from Rockingham to Rockbridge in the early 1800’s and by 1833 their father and uncle followed them there. At this time I have no proof that these 3 men were brothers or that they are the sons of a Samuel H. Vess or William (mentioned earlier) but due to their proximity to each other it is entirely likely.
The ‘eldest’ Vests that appear in Rockbridge Co. did not show up in the records nearly as early as the younger Vests. One of the eldest was Samuel H. Vest (alluded to earlier), who appeared in the Rockbridge Co. tax records and paid taxes from 1833 through 1847. (1847 possibly indicates the year of his death.) In the 1840 census he is listed as over 80 years of age. He may well be the father of our Samuel Sr.(b.1780) but at this time I have found no proof. In the absence of any court records listing him in Rockingham Co. and the fact that he doesn’t appear in 1810,1820,or 1830 census records for either Rockingham or Rockbridge Co., I have no idea where he lived during this time span. He is the most likely candidate to be the same Samuel H. Vest that married (remarried?) to Ann McPherson on 2/27/1833 in Rockbridge Co. Because he was born before 1760 indicates he may be the Samuel that lived in southern Shenandoah Co. in 1775 and served in the Rev. War. This becomes more likely because also appearing in the Rockbridge Co. records is a William Vest. He, also is in the 1840 census and is also listed as being over 80 years of age. Like Samuel H., he may be the William that served in the Rev. War. He paid taxes in Rockbridge Co. and it appears that he stopped paying in 1841. (In the 1840 census of Rockbridge, there were 3 separate William Vests so it is impossible to know for sure when this particular William stopped paying taxes.) This elder William and Samuel H. were likely brothers but I have no records substantiating this. Also, I have no records to prove their off spring as mentioned earlier.
The very earliest record that I have located in the Rockbridge Co. web site that was possibly a Vest is where a Samuel West sold land in 1780. As stated early on and will show up later in the Rockbridge census, occasionally the name was changed to West. However, I examined the deed personally and discovered that it wasn’t a ‘West’ but a Samuel ‘Weiss’. He and his wife Margaret sold 120 acres to Thomas Steel on 7/29/1780 for 3000 pounds. Three times later in the deed it was spelled ‘Weis’. The person that copied it for the web site apparently erred. I then went to the Augusta Co. court house to search for when this Samuel Weiss purchased the 120 acres (due to it’s date) in order to see how his last name was spelled but was unable to find anything. Rockbridge was formed from Augusta in 1780.
The earliest Vess that I have found in Rockbridge Co. is in the 1810 census where Samuel Vass aged 26 to 45, wife aged 26 to 45, 4 sons, and a female over 45, are listed. This Samuel called himself Samuel Sr. when he posted bond for his son Samuel Jr’s. marriage in 1832. Samuel Sr. (He will be referred to as Samuel Sr. throughout this document) will be covered, along with his descendants later in this report. This Samuel appears as ‘Sr.’ in the tax records starting in 1832. It is my opinion that Samuel Sr. is the same Samuel that married in 1804 in Rockingham Co. to Mary Linor (or Liner) d/o Philip Linor. See marriage record ‘Exhibit C’. Notice that the recorder translated the name Samuel Vesst (note spelling) to Samuel West. This makes it obvious that not only must we watch for Vess and Vest but also aware that it could end up to be West. Another point to notice is that Philip Linor signed this permission himself and that the last name is Linor as opposed to the name of Lyons that has been reported in some of the histories.
Also, in Rockingham Co. there is a marriage and an1810 census record that may hold some clues. The Rockingham Co.1810 census record shows a Hiram Vess (listed as Oess in one record) aged 16-25, a wife aged 16-25, and a daughter under 10 years. Since Hiram is not listed in the Rockbridge Co. census for 1810 but is listed in the 1820 census in Rockbridge, indicates the possibility that this Hiram had followed his brother Samuel to Rockbridge. (As well as his father-in-law.) The fact that Hiram moved to Rockbridge Co. does not make him a brother to Samuel but increases the possibility. As you can see in the attached marriage record, (see Exhibit D) Hiram was married in Rockingham Co. in 1809 to Betsy Welchorns. This Hiram appears in census’s of 1820, 1830, and 1840 in Rockbridge Co. and had to have been born in 1790 in order to agree with his age listing in all 4 census records. I’m confident that this date of birth is accurate and it contradicts the birth date of c.1798 that has been published in so many records. It is also documented that this Hiram is the son of Samuel Sr. and this is very unlikely because of his age and the fact that he is never listed as an heir to Samuel Sr’s. estate. It also should be noted that Hiram purchased land from William Welchorns, (His father-in-law) in 1817 in Rockbridge Co. This confirms the fact that he is the same Hiram that first lived in Rockingham Co. and then relocated to Rockbridge. This Hiram’s first wife Betsy may have died between 1810 and 1820 and it is most likely that this Hiram remarried to Julia ‘Polly’ Cochenour on June 22 1819 in Rockbridge Co. (There was no other Hiram of the proper age to get married in 1819.) We will cover this Hiram and his descendants later.
Also found in the Rockingham marriage records is a John Vess that married Mary Carthrau in 1800. See Exhibit ‘E’. Also found in Rockingham is where a John Vass signed over land to his attorney to dispose of, located in Port Republic and the land had been given to him by John Carthrau, now deceased on 12/20/1805. (This was John Vess’s father-in-law). This was transacted on 6/19/1827 and it stated that John Vass now lives in Monroe Co.,(now West Virginia) The Rockingham Co. census doesn’t list a John Vess in 1810, however it does list a John West aged 26-44, a wife 26-44 , 2 sons under 10, and 3 daughters under 10. As mentioned earlier, the recorder often changed the name ‘Vest’ to ‘West’ so this John West is possibly our John Vest. In the 1820 Rockingham census we find a John Evest (whether this is a copying error or our John Vest with a middle initial of ‘E’ is questionable) listed at age over 45, a wife 25-45, 4 sons, and 3 daugh. Now, in 1830 we see a Jon Vest listed in the Rockbridge Co. census at age 50+, a wife 30-40, 2 sons and 2 daugh. It is far from certain that this Jon is the same John that lived in Rockingham Co. Again, he is in the 1840 Rockbridge census at age 60-70, a wife 40-50, a son, and 8 daugh. This John is listed as John Sr. in some of the tax records and he paid taxes in Rockbridge from 1835 through at least 1845. Although we know that one son was named John Jr., at this time I have no knowledge of any other of his descendants. Some histories say that this is the John that lived in Bedford Co., Va. although there also was a John Vest in Bedford Co., it actually was a John Vest Sr. and Jr. and their purchases of land in Bedford Co., in addition to many other court records including John Sr’s. will in 1836 indicate that they are not the same Vests that were located in Rockbridge Co.
When this Bedford Co. John Vest applied for a pension for the Rev.War, this is how he described his movements when he applied for it in 1833; “He was born in the county of Powhatan in Virginia in the year 1750, and in the ninth year of his age his father moved with him into the county of Rockingham in said state where he lived about eleven years from thence he moved into the county now called Campbell , then a part of the county of Bedford in said state where he resided till he became of age and lived then through the whole of the Rev. War. In 1789 he became a citizen of Bedford Co. or that part of it which now retains that name and has ever since and does now reside there by his calculation he is now about eighty two years six months and seven days.” He also stated that his father had obtained a discharge for him from Capt. Talbot well after the end of the war indicating that his father was alive and also living in Bedford Co. in the late 1700’s. His father of course would have been born around 1725. Therefore, it is my opinion that the John found in Rockbridge may be related to the John in Bedford Co., especially since they both lived in Rockingham Co. at one time, but they most likely are not the same person.
To further support this we see where a John Vest Jr. and a John Vest Sr. were sued in Campbell Co. in the year 1786. This makes it fairly obvious that the John Jr. was of age and most likely the war veteran. To add to the confusion there were at least ten Vest households in Campbell Co. before 1800 and I also have found several early Vest households in Bedford Co. however no definite connections to our Rockbridge clan that I am aware of at this point in time.
This pretty much concludes the introduction to my account of the Rockbridge Vess/Vest family until further data is learned. Note that this document only includes descendants for the first three generations and does not intend to include all descendants that I have records for. Also, all references to census are for Rockbridge Co. unless otherwise stated. Also note, to make it easier, I have stayed with just one spelling, ‘Vest’, even though it is spelled Vess just as often and hopefully it won’t offend anyone. Please forward any corrections, additions, or disputes. I would greatly appreciate them.
Samuel Vest, Sr. (1780-1841)
As mentioned earlier in this report, this Samuel Sr. is likely the same Samuel that married Mary Linor in Rockingham Co. in 1804 and likely was the son of Samuel H. that was born c.1750. By following his age listed in the 1810, 1820, 1830, and 1840 census’s, it appears he was born in 1780. His spouse is listed in the census up through 1840 however I’ve been unable to find any data for her after that time. She does not appear in the households of any of her daughters (or sons) in the 1850 census, so I believe that she may have died between 1840 and 1850. Since she is never mentioned in any of the court records described below, it is most likely that she died before Samuel in 1841.
The following is how Samuel Sr. is listed in the Rockbridge Co. census’s;
1810; Samuel is age 26-45, wife 26-45, 4 sons under age 10,
1 female over age 45. ( She could have been related???)
1820; Samuel is age 26-45, wife 26-45, 2 sons under age 10, 4 sons
10-16 and 2 daugh. under age 10.
1830; Samuel is over 50, wife over 40, 1 son under 5, 2 sons 5-10,
1 son 10-15, 1 son 15-20, 1 daugh. 5-10, and 1 daugh. 10-15,
and 1 daugh. 15-20.
1840; Samuel is over 50, wife is over 50, 1 son 10-15, 1 son 15-20,
1 son 20-30, 1 daugh. 15-20, and 2 daugh. 20-30. ( Some of these
could have been daugh.-in-laws.)
We will begin the descendancy lists by starting with this Samuel Sr. because his heirs are easily identified by the court documents surrounding the land purchase that he made not long before his death. He apparently purchased some land from a William Tolley without the deed being transferred properly. Then both he and William Tolley died which caused a lot of court action to transpire between their heirs. These court records are numerous and are consistent in the naming of Samuel’s heirs. The first record of his death that I have located is ;
‘Accounts and bonds appraised to the administrator with future settlement’ and it names Samuel Vest had $75 with interest from Sept. 1, 1841. This most likely was his death date. Again, later appearing in Will Book 10, page 511 is; ‘Samuel Vess estate with settlement by his administrator Hiram Vess, on Aug. 12,1842. With the amount of inventory valued at $462.75.’ I don’t know for sure if the administrator was his son named Hiram or his brother by that name.
By my studies of the records that I have found, (several dates found in records do contradict each other), the following is the list of Samuel Sr.’s children and my estimation of their birth dates. My studies did not include Samuel Sr.’s grandchildren (except for my direct line), so, for the grandchildren I have taken the liberty to include data from other people’s research and have added my findings from census, etc. Please forgive me if I have propagated errors. At the time of this writing, I have records that show that Samuel Sr. had a minimum of 50 grandchildren and 126 gr-grandchildren.. Also, at this time I wish to point out that my tax records are from 1825 through 1850 only, therefore, when I mention they paid taxes through 1850, it does not mean that they did not pay taxes after that year. Also note that I have only searched up through the 1880 census and have not studied the census for1890 or later.

Listed as heir to Samuel Sr., paid taxes 1832 through 1850. Was reported by a neighbor as the son of Samuel and Peggy when he died. He married Sarah Novell, daug. of John Novell, on 9/27/1832.
Census; 1840 He was age 20-30, wife age 20-30, 3 sons, and 1 daugh.
1850 He was age 42, Sarah age 35, Samuel A. age 16, John age 14, William A. age 12, Sarah A. age 10, Martha Amanda age 5, James F.(or P.) age 3, and Calvin age 2.
1860 He was age 50, Sarah age 52, John age 24, William age 22, Sarah age 19, Amanda age 16, James age 14, Calvin age 12, George age 9, Nancy age 6.
1870 (He was deceased), Sarah age 57, Calvin age 21, James F. age 23, George age 17, Sarah Ann age 30, and the rest were most likely Sarah Ann’s children, Amanda J. age 8, Wingfred age 6, and Jessie age 2.
1880 He was deceased, Sarah T. age 66, James T. age 28.
William and Sarah’s descendants are;
C1. Samuel A. b. 1834 d.9/17/1871. He served in Co. C., 14th Va. Cav. Samuel A. first married Mary Ailstock. She was deceased by 1859. The 1860 census lists Samuel A. age 28, son Lewis C. age 4, and son John age 1. Samuel A. remarried to Bethsheba Hostetter on 2/12/1863. She was the daugh. of David Hostetter.
1870 census lists Samuel A. age 37, Bethsheba age 27, Lee Johnson age 6, Virginia age 4, Savilla age 4, Mackey age 10/12.
1880 census, Samuel is deceased, Bethsheba age 35, Lee Johnson age 16, Virginia P. 14, Savilla Frances age 13, Alexander Mackey age 10, Sidney W. 10/12. (Who was his father???)
Note: It is stated in at least one history that Lee Johnson was listed as ‘colored’ when he married in 1892 to Rebecca Lee Hostetter, therefore possibly having Indian blood however I studied the 1870 and 1880 census’s carefully and both he and his siblings are always listed as ‘white’. (Again, ????)
Therefore, Samuel A. and Mary had the following children;

Elizabeth J. age 5, John age 3, and Susan age 2. Census in 1880 lists William age 45, wife Mary is absent, Elizabeth J. age 14, John A. age 12, Susan A. age 10, Charles F.(or E.) age 8, Jacob age 6, and Harvey age 3. Apparently his wife Mary had died from 1877 to 79.
Therefore, William A. and Mary had the following children;

Hiram Vest (1790-185???)
This is the same Hiram that was mentioned earlier on page 3 of this document. Refer to Exhibit D for his marriage record. In Rockingham Co. he was married in Jan. of 1809 to Betsy Welchorns, daugh. of William Welchorns. (See Exhibit D) As mentioned before, he most likely is a brother to Samuel Sr. and son of Samuel H. Vess b.c.1755. Hiram appears in the 1810 census in Rockingham Co., then moved to Rockbridge Co. where in 1817 he purchased land from his father-in-law William Welchorns. He most likely is the same Hiram that married Julia ‘Peggy’ Cochenour daugh. of Christian on 6/22/1819 in Rockbridge Co. He was the only Hiram of the proper age to marry. (Samuel Sr.’s son Hiram was only 9 years old at the time.) Possibly his first wife Betsy died , then he remarried. Hiram and family appear in the 1820 census in Rockbridge Co. Most likely at least 3 of his children were with Betsy. Hiram doesn’t appear in the tax records until 1829 and then he paid from 1832 through 1850 indicating he was alive through 1850 however I could not find him listed in the 1850 census. He could have moved or died around 1850. The following is a list of him throughout the census’s;
Rockingham census for 1810; Hiram age 16-25, wife age 16-25, 1 daugh. under age 10.
Rockbridge census’s; 1820; Hiram age 26-45, wife age 26-45, 2 sons under 10, 1 son 10-16, 1 daugh. under 10, and 1 daugh. age 10-16.
1830; Hiram age 40-50, wife 30-40, 3 sons under 5, 1 son 5-10, 1 son 10-15, 1 son 15-20, 1 daugh, 5-10, and 1 daugh. 10-15.
1840; Hiram age 40-50, wife 40-50, 1 son 5-10, 2 sons 10-15, 2 sons 15-20, and 1 daugh. 15-20.
Since I am not directly connected to this Hiram I haven’t searched thoroughly enough to identify all of his children however with the use of other researchers data and using those records that I have, the following list is my estimation of the names and birth years of the most likely candidates to be his descendants. Please let me know of anything that disagrees with known data. Please keep in mind that I don’t have proof of this lineage.

6. Mathew Madison Vest (1826-1872)
Mathew Madison Vest is listed as two separate persons in some histories however as can be seen in the following census records, it is evident that he went by both names. Mathew served in both the Rockbridge 1st and 2nd Artillery, C.S.A. He first married to Sarah Moore on 2/6/1846 and she died just after giving birth to their 6th child on 2/18/1860.
Sarah was the daugh. of John and Catherine ‘Siders’ Moore. Mathew died sometime in 1872 and his estate was appraised and recorded on 7/10/1872 at a value of $488. The Co. Sheriff was the Admin. and his wife Mary A. was mentioned in the disposition.
In the 1850 census he is listed as Madison age 24, wife Sarah age 28, son John T. age 3 and daugh. Mary I. age 1.
In the 1860 census he is listed as Mathew (note name change) age 35, (wife Sarah had died earlier in the year and is missing in the census), son John T. age 13, Mary J. age 11, Jacob C. 9, William age 7, Phil age 3, H. Frances age 2, and Sally A. age 5/12 . He paid taxes 1848 through 1850.
Therefore Mathew and Sarah had the following children;

Mathew Madison remarried to Mary Ann ‘Archey’ Steele, widow of John Steele and daugh. of Peter and Abby ‘Morris’Archey on 8/16/1860. It stated that Mathew was a widower and the son of Hiram and Julia. Mary had 4 children by her first marriage. Eliza Jane Steele, Margaret Steele, Abigail Steele, and Frances Steele.
Conclusion:
This pretty much concludes all of the information that I have gathered about the Rockbridge ‘Vests’ at this time. This work was done for everyone and I hope some of you get as much enjoyment with it as I have in putting it all together. Please forward all disputes, changes, and additions.
There was one more Vest that appeared in Rockbridge records that I have no idea how old he was or if he was connected to the our other Vests or not. He only appears in records for a short period and never in the census’s, so I can not even guess his age. There is some possibility that he was an early son of Hiram and his wife Betsy. And he was;
Philip H. Vest He paid taxes in years 1835 and 1837. And according to Deed book
‘U’, page 33, he sold land to James S. Gold in 1837. He then
disappears and I have no further data.
Also found in the Civil War records were some Vests from Rockbridge Co. for which I have no records for. They were; Alexander Vest, Jacob Henry Vest, and Thomas R.Vest.

Tunnel Hill Cemetery[25] is located off Route 633, south of the town of Millboro, it is called Tunnel Hill Cemetery, as the train passes through this hill, it has been known as Tunnel Hill since the 1800's. It is on the south side of the road, it has tombstones and one gated surround, it is in disarray and unkempt condition. Found there are 70 depressions of 1 ½ feet in depth, there are no markers on these depressions, 15 depression of 2 feet or more, with no markers.

[1] It appears that the cases of illegitimate children within the Ailstock line are rampant. Much of it has to do with the fact that there are many links to slavery and free slaves within this family.
[2] Eliza is the widow of George Ailstock, at this time I believe George to be a son of Absolom (abt 1756-1854). Eliza’s children eventually make it to Rockbridge County with the rest of the Ailstock family.

Many records state that family members have been categorized "Mulatto". It seems that the term is open to much debate and that nobody is really sure if the original Ailstock race were "Negro" or Indian. Ailstock cousin, Diana Havens, expands on the Indian heritage view in an article within this text.

[11] It is reported to me from Ailstock cousin, Kitty Sachs, that Andrew Ailstock and Pheobe Ricket Morris (one time wife of Elihu B. Morris were married by common law – and that Andrew adopted Pheobe’s children from her previous marriage. The Morris name is mentioned in the birth record of Sarah M. Ailstock, daughter of Andrew and Pheobe. Information passed on to me from my grandmother, Alma Mitchell, says Andrew married Pheobe Vess – Annie Elizabeth Ailstock’s death record also shows her mother as Pheobe Vess (but there is a middle intial “M” in her name that is not explained.) I am still researching leads to prove Pheobe's last name. Andrew may also have been married more than once - a fact I need to research further.
[12] The will of Andrew Ailstock was executed on August 3rd 1862, and Andrew died in November of that year. In this will she noted that he had been living with Pheobe Morris for 8 years and never married, but acknowledged that he was the natural father of Alice, Sally (Sarah Margaret), and Julia. Noted Ailstock researcher, Odell McGuire, relays that: John Ricketts, a free negro, made and laid bricks at Rockbridge Alum Springs where the Sally Ailstock family lived. His daughter, Phoebe Ricketts, became Andy Ailstock's common law wife. She brought older children to the marriage and had Children by Andrew, as well. Andrew did not acknowledge the older children in his will, but they went by the Ailstock name.
[13] Elihu Morris family in this census tends to disprove story that Pheobe, wife of Andrew Ailstock, was the widow of Elihu Morris (Morris children not listed: Mark -19, Telford -15, David -14, Nancy J. -12, Mary A -9, Estaline -7.
[14] On 5 Jan 1869, Charles Grigsby married Annie Elizabeth Ailstock in Rockbridge County, VA. Annie was the daughter of Andrew and Pheobe Ailstock. Andrew Ailstock was the grandson of Absolom Ailstock, a prominent “colored freeman” who settled in Louisa County, VA and was a veteran of the Revolutionary War.
[15] Pheobe Aylstock, widow of Andrew, was the mother of Annie Elizabeth Ailstock.

According to "Virginia Soldiers of 1776", by Burgess (1973, pg. 1246/7), Absolem Ailstock enlisted as a Private in the Albemarle Company of Captain Harris (joined at Williamsburg, 19 Sept., 1781 and was discharged 6 Nov. after 48 days). Also, Fred provided me with a deed record for the land in Rockbridge County, VA, that Absalom received for his war service.

[24] This will proves that Andrew had a common law marriage with Phebe Morris. Many Ailstock cousins say she was the wife of Elihu B. Morris – but I do not see any sign this is true based on the fact that Pheobe and Elihu are still living with each other in the 1860 census. I did find where Pheobe Morris married William Vess in 1832 and there seems to be no sign of them after this. I am trying to verify if this Pheobe Morris Vess is in fact the Pheobe Vess that was reported as “mother” in the death certificate of Annie Elizabeth Ailstock. I also find it strange that Andrew’s will makes no mention of Preston and Annie Elizabeth Ailstock in his will – which makes me think that they were not his children.
